Red-zoned 'Quake Outcasts' to be paid - but not all will go

Some of Christchurch's "Quake Outcasts" will get compensation more than seven years after their properties were red zoned - but not all are celebrating.
Greater Christchurch Regeneration Minister Megan Woods announced on Tuesday the 100-strong group of uninsured Christchurch red-zone property owners, who were not paid out for their homes during the Government buyout, would receive payouts in the next few weeks.
They were previously offered the value of their land.

There are 103 people left who had not been paid by the Government for their uninsured red zone houses.
However the payout, based on 2007/08 rating valuations, is voluntary and not all will take it and leave their homes.

Greater Christchurch Regeneration Minister Megan Woods says the plight of those uninsured when the quakes struck was "one of the difficult legacies of the earthquakes".
"We aren't interested in a 2007 valuation - this is 2018," Martin Francis said.
They would happily remain in their home "unless we can replace what we've got here - we've got four bedrooms, two bathrooms and double glazing."
They had essential services and a view of the river, he said.

Annette Wilkes is one of the group. She previously said it was "utterly ridiculous" someone could come and take something that belonged to her because it was uninsured.
The Government's offer follows a 16-member class action. The court ruled former Earthquake Recovery Minister Gerry Brownlee made an "unlawful" decision to discriminate against the uninsured homeowners.
Those in the legal action were paid out, but others in the same position were not.
The total cost is expected to be about $12 million.

Woods said the plight of those uninsured when the quakes struck was "one of the difficult legacies of the earthquakes".
"It's time to resolve this longstanding issue and provide certainty for everyone involved, so I am implementing this decision immediately."
Christchurch Mayor Lianne Dalziel welcomed the news and said it had been a long struggle for residents.
"We have always said that every property owner in the residential red zone should have received the same offer for their property, regardless of their insurance status," she said.
Woods said the Government had carefully considered a number of different factors in response to the Court of Appeal's 2017 judgment in the Quake Outcasts litigation.
"It took some time to make this decision because we wanted to make sure it was the right one. We had to consider fairness and consistency, the precedent this decision may set, and the need to be fiscally responsible."
The Crown was willing to purchase the remaining privately-owned red zone properties, if the owners were interested in selling their property for its 2007/08 rateable value, she said.

This payment is being made as Gerry Brownlee acted illegally creating red zones, forcing people off their land and out of their homes by threatening removal of services, Some homes were not badly damaged, although uninsured, and families could have stayed if they had not been red zoned.
It has nothing to do with insurance, in my opinion. It is not enough (payment) considering they are getting the Q.V. from 11 years ago.

In my case, had we not been red zoned, we would have remained at 523 New Brighton Rd., and pursued repairing the property, after all, shortly after the 4 September, 2010 7.1 M earthquake, builders were already discussing any work required to correct a drop in the floor level in the lounge, and rectify a damaged conservatory.
There was no talk of 'red-zoning' anybody at this stage, and the subsequent 22 February 22, so-called '6.1' M earthquake* had little further damage done to the pre-existing quake damage which was deemed repairable. [blogger]

Their houses were not destroyed. Government/Insurance companies cheapest solution was to red zone this land. As part of that government decision they wrongfully expected uninsured people to walk away from their livable assests. Disgraceful.

That's B.S. All of us who paid our insurance only got paid out because we had proper house insurance. If you are going to pay out to those who didn't have home insurance then you need to reimburse the insurance premiums to all customers who had proper insurance.

But were you RED ZONED then offered only RV no negotiation? All property transactions are based on the principle of "Willing Buyer, Willing Seller."

The need to appease reinsurers who were aghast at the massive liability delivered to them as a result of changes to EQC made by the National party are certainly a major reason for red zoning. Fact.
The reinsurers were threatening to 'walk away from Canterbury if not NZ' as a direct result of the failure of Bill English to update EQC's building damage capacity as he was advised to do in 2008. Understandably National's social media consultants are still all over this issue furiously obfuscating....as it is such a major example of economic incompetence and gross negligence by the former National Government. Own it.

As it is unrelated, how can you get an offer that others do not get?

Ugh. Are we still needing to clarify seven years later that many houses in the so-called red zone were left repairable and habitable.
They had every right not to insure their home and as it happens they took the risk and won.
Then Gerry decided to make life easier and cheaper for foreign insurance companies and boom you have a 'red zone" and people are forced off their land and out of their homes. Nobody who didn't have insurance and wasn't in the red zone is getting a pay out for the value of their home. +22

Man, I can't believe so many haters on here who actually don't understand the scenario and the actual background of being forced off your land. It is not an insurance issue and that is why an impartial justice system at the highest level (Court of Appeal) ruled against the government.
This is totally fair and democracy working and keeping bad decisions of the previous government in check. To everyone saying your are going to cancel your insurance, then good luck if you have a flood, fire or earthquake and can stay where you are because you will end up with nothing.

Coastal Christchurch resident Pete Watkinson has been told he cannot build a home on the property he purchased in November 2017. The section is sitting empty, and is essentially worthless.
A dispute has erupted between Christchurch City Council bosses and elected representatives over claims the district plan was deliberately altered, potentially leaving homeowners in flood-prone areas millions of dollars out of pocket.
City councillor David East has called for an independent inquiry into claims staff tampered with the plan and erased a clause after it had been signed off.
Community leaders said the apparent sabotage amounted to "red-zoning by stealth", suggesting people in New Brighton, Southshore and Redcliffs may have been left millions of dollars out of pocket.
Pete Watkinson told Stuff his plans to build a new home in Southshore had been scuppered by the planning process, leaving his family on the verge of moving into a caravan.

Speaking at a press conference on Monday, East said the alleged tampering had "denied residents their legal rights" and caused "huge emotional stress and community upheaval".
The Christchurch City Council fought the inclusion of the clause, which made it easier for people to develop homes and land in flood-prone areas, during the process of the plan's ratification two years ago.

Residents in New Brighton and Southshore in Christchurch feel they are hamstrung in efforts to develop homes in the area because of restrictions in the council's district plan.
Despite an independent hearings panel ordering it to be included, it was left out of the final version.
The omission – which was known about – was previously thought to be an oversight.
But local politicians claim council staff admitted during a meeting last month the clause was deliberately deleted from the plan's final draft because they did not support its inclusion.
East said the omission had caused "undue and unnecessary financial stress" for residents in his ward, seriously affecting their health.
